1. Agreement to Terms

By accessing or using winklly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

winklly is a web-based platform that allows users to save, organize, and summarize digital content using artificial intelligence. The Service includes:

• Saving and processing URLs, articles, and web pages.
• Uploading and processing documents, images, videos, and audio files.
• AI-generated summaries, categorization, and key point extraction.
• Integration with third-party services such as Telegram.

2.1 WhatsApp

WhatsApp is a third-party service. Connecting or enabling WhatsApp requires a valid WhatsApp account and compliance with WhatsApp/Meta terms. When connected, winklly may process chat message bodies you use with the product (including for AI-assisted summaries) as described in the Privacy Policy. winklly is not responsible for WhatsApp outages, account restrictions, content removed or blocked by WhatsApp/Meta, or changes to WhatsApp APIs or policies. You are responsible for lawful use of chats and data you connect.

If you turn on WhatsApp notifications, you can turn them off at any time. Your carrier or data charges may apply.

2.2 Calendar export

When your content contains a date or an appointment, winklly may offer to add it to your calendar as a downloadable .ics file or through a Google Calendar link. These suggestions are generated automatically and may be wrong or incomplete, so check the date, time, and details before you save the event. Google Calendar is a third-party service provided by Google under its own terms.

3. User Accounts

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete registration information.
• You are responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Upload or share content that infringes on intellectual property rights.
• Upload malicious files, viruses, or harmful code.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use automated tools to scrape, crawl, or overload the Service.
• Resell or redistribute the Service without our written consent.

5. Content & Intellectual Property

5.1 Your Content

You retain ownership of all content you submit to winklly. By submitting content, you grant us a limited license to process, store, and display it as part of the Service.

5.2 AI-Generated Content

Summaries and other AI-generated outputs are provided for informational purposes. Some features use third-party AI providers, such as Google Gemini and TypeSafe AI, reached directly or through routing services such as OpenRouter. When you ask a question, your question and information from your saved items are sent to these providers to generate an answer, as described in the Privacy Policy. Voice notes are transcribed by our AI providers, and any opinion or explanation may be wrong. While we strive for accuracy, AI-generated content may contain errors or omissions. You are responsible for verifying the accuracy of any AI-generated content before relying on it.

The winklly brand, logos, design, and code are our intellectual property and are protected by copyright and trademark laws.

6. Subscription & Payments

• winklly offers a Free tier at USD $0 with limited usage, and paid Pro and Ultra tiers.
• Pro is USD $5.99/month and Ultra is USD $14.99/month, billed monthly. You may cancel at any time.
• Paid plans are billed monthly. We do not currently offer annual plans.
• Refunds are available within 14 days of purchase if you are not satisfied.
• We reserve the right to change pricing with 30 days' notice.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may temporarily suspend the Service for maintenance, updates, or unforeseen issues. We are not liable for any losses resulting from service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, winklly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

To the maximum extent permitted by law, winklly's total aggregate liability for all claims arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) USD $100. This limitation does not apply to liability that cannot be limited under applicable law, including liability for intentional misconduct or gross negligence, and does not affect your rights under mandatory consumer protection laws.

9. Account Termination

• You may delete your account at any time from the settings page.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, your data will be deleted within 30 days.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts in Jerusalem, Israel, except where applicable law gives you a mandatory right to bring a claim elsewhere.
